California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 5.3 — Commercial and Industrial Common Interest Developments, Chapter 4 — Ownership and Transfer of Interests, Article 3 — Transfer of Separate Interest, Section 6664

In a planned development, any conveyance, judicial sale, or other voluntary or involuntary transfer of the separate interest includes the undivided interest in the common area, if any exists. Any conveyance, judicial sale, or other voluntary or involuntary transfer of the owner’s entire estate also includes the owner’s membership interest in the association.

Notes

Establishes that any conveyance, judicial sale, or other voluntary or involuntary transfer of a separate interest in a planned development also transfers any undivided common-area interest. A transfer of the owner's entire estate likewise includes the owner's membership interest in the association, so those associated interests pass with the transferred estate.
