California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 6 — Works of Improvement, Title 3 — Public Work of Improvement, Chapter 4 — Stop Payment Notice, Article 4 — Enforcement of Payment of Claim Stated in Stop Payment Notice, Section 9506

If more than one claimant has given a stop payment notice:

(a) Any number of claimants may join in the same enforcement action.

(b) If claimants commence separate actions, the court that first acquires jurisdiction may order the actions consolidated.

(c) On request of the public entity, the court shall require that all claimants be impleaded in one action and shall adjudicate the rights of all parties in the action.

Notes

Allows multiple stop-payment claimants to join the same enforcement action and allows the first court acquiring jurisdiction to consolidate separate actions. Requires, at the public entity’s request, all claimants to be impleaded in one action so the court can adjudicate every party’s rights together.
