This chapter does not apply to a phototherapy device used by or under the direct supervision of a licensed physician who is trained in the use of phototherapy devices.
Notes
Exempts a phototherapy device from the chapter when the device is used by, or under the direct supervision of, a licensed physician trained in the use of phototherapy devices. The exemption depends on both physician licensure and the physician’s phototherapy-device training, together with use or direct supervision.
