Nothing in this chapter prohibits any of the following:
(a) A selection of customers.
(b) A functional classification by any person of any customer as broker, jobber, wholesaler or retailer.
(c) A differential in price for any article or product as between any customers in different functional classifications.
Notes
Allows businesses under this chapter to select their customers, functionally classify customers as brokers, jobbers, wholesalers, or retailers, and charge different prices to customers in different functional classifications. These practices are expressly not prohibited by the chapter, so customer selection, functional classification, and classification-based price differences remain permitted notwithstanding other provisions governing unfair practices.
