California CodesBusiness and Professions Code - BPCDivision 6 — Business RightsChapter 2 — Model State Trademark LawArticle 9 — ViolationsSection 14259

Nothing herein shall adversely affect the rights or the enforcement of rights in marks acquired in good faith at any time within common law.

Notes

Limits this chapter from adversely affecting rights in marks that were acquired in good faith under common law or the enforcement of those rights. The provision preserves qualifying common-law mark rights regardless of when they were acquired, so registration rules in this chapter do not extinguish or impair preexisting or later good-faith common-law rights or their enforcement.
