(a) This article shall not apply to a real estate licensee who submits proof satisfactory to the commissioner that the real estate licensee has been a real estate licensee in good standing for 30 continuous years in this state and is 70 years of age or older.

(b) A “real estate licensee in good standing” is one who holds an active license that has not been suspended, revoked, or restricted as a result of disciplinary action, who has not surrendered a license while under investigation or while subject to a disciplinary action, or received an order of debarment.

Notes

Exempts a real estate licensee from the article upon proof satisfactory to the commissioner that the licensee has held a California real estate license in good standing continuously for 30 years and is at least 70 years old. Good standing requires an active, unrestricted disciplinary record, no surrender while under investigation or discipline, and no debarment order.
