An offer of performance is of no effect if the person making it is not able and willing to perform according to the offer.

Notes

Limits the effectiveness of an offer of performance to situations in which the person making the offer is both able and willing to perform according to its terms. An offer made without the actual ability or willingness to carry out the proposed performance has no effect.
