An offer of performance must be free from any conditions which the creditor is not bound, on his part, to perform.

Notes

Requires an offer of performance to be free of conditions that the creditor is not obligated to perform. A debtor may not make a valid tender contingent on the creditor doing something beyond the creditor’s own duties under the obligation.
