The thing to be delivered, if any, need not in any case be actually produced, upon an offer of performance, unless the offer is accepted.

Notes

Allows a person offering performance to make the offer without actually producing the thing to be delivered unless the offer is accepted. Physical production of the item is therefore unnecessary at the tender stage, but the exception ends when the creditor accepts the offer.
