California CodesCivil Code - CIVDivision 3 — ObligationsPart 1 — Obligations in GeneralTitle 4 — Extinction of ObligationsChapter 2 — Offer of PerformanceSection 1501

All objections to the mode of an offer of performance, which the creditor has an opportunity to state at the time to the person making the offer, and which could be then obviated by him, are waived by the creditor, if not then stated.

Notes

Establishes that a creditor waives objections to the manner of an offer of performance when the creditor had an opportunity to state those objections at the time of the offer and the person making the offer could then have corrected them. Only objections meeting both conditions are waived by silence.
