The title to a thing duly offered in performance of an obligation passes to the creditor, if the debtor at the time signifies his intention to that effect.
Notes
Establishes that title to a thing duly offered in performance passes to the creditor when, at the time of the offer, the debtor signifies an intention that title pass. The transfer therefore depends on both a valid tender and the debtor’s contemporaneous expression of intent to transfer ownership.
