If judgment be rendered upon the right of the person so alleged to be entitled, in favor of such person, he may recover, by action, the damages which he may have sustained by reason of the usurpation of the office by the defendant.
Notes
Allows a person who receives a favorable judgment establishing the person’s right to the office to bring a separate action for damages sustained because the defendant usurped the office. The recoverable damages are those the person sustained by reason of that usurpation.
