California Codes, Civil Code - CIV, Division 2 — Property, Part 4 — Acquisition of Property, Title 4 — Transfer, Chapter 1 — Transfers in General, Article 4 — Interpretation of Grants, Section 1069

A grant is to be interpreted in favor of the grantee, except that a reservation in any grant, and every grant by a public officer or body, as such, to a private party, is to be interpreted in favor of the grantor.

Notes

Requires a grant generally to be interpreted in favor of the grantee, but requires reservations in a grant and grants made by a public officer or public body to a private party to be interpreted in favor of the grantor. The provision therefore states both the default construction rule and its express exceptions.
