California Codes, Civil Code - CIV, Division 2 — Property, Part 4 — Acquisition of Property, Title 4 — Transfer, Chapter 1 — Transfers in General, Article 4 — Interpretation of Grants, Section 1068

If the operative words of a grant are doubtful, recourse may be had to its recitals to assist the construction.

Notes

Allows recitals in a grant to be used to interpret the instrument when its operative words are doubtful. The provision makes recitals an interpretive aid only in that circumstance and does not state that they override clear operative language, establish a deadline, or create a monetary consequence.
