(a) A local jurisdiction may enforce this division and the regulations promulgated by the department if delegated the power to do so by the department.
(b) The department shall implement the delegation of enforcement authority in subdivision (a) through an agreement between the department and the local jurisdiction to which enforcement authority is to be delegated.
Notes
Allows a local jurisdiction to enforce the division and department regulations when the department delegates that enforcement authority. The department must implement any delegation through an agreement with the local jurisdiction receiving the authority, so local enforcement under this provision depends on an affirmative department delegation and agreement.
