California CodesBusiness and Professions Code - BPCDivision 2 — Healing ArtsChapter 7.7 — Physician AssistantsArticle 6.5 — Diversion of Impaired Physician AssistantsSection 3534.10
Participation in a diversion program shall not be a defense to any disciplinary action which may be taken by the board. This section does not preclude the board from commencing disciplinary action against a physician assistant who is terminated unsuccessfully from the program under this section. That disciplinary action may not include as evidence any confidential information.
Notes
Prohibits physician-assistant diversion-program participation from serving as a defense to board disciplinary action and allows the board to discipline a physician assistant who is unsuccessfully terminated from the program. Bars confidential diversion-program information from being used as evidence in that disciplinary action, preserving that confidentiality despite the board’s authority to proceed.
