California CodesBusiness and Professions Code - BPCDivision 2 — Healing ArtsChapter 8.3 — Respiratory TherapyArticle 5 — Suspension, Revocation, and Reinstatement of CertificatesSection 3751.5

Notwithstanding Section 489, a person whose application for licensure has been denied for cause may reapply to the board for licensure only after a period of three years has elapsed from the date of the denial.

Notes

Bars a person whose licensure application was denied for cause from reapplying to the board until three years have elapsed from the date of denial. The three-year waiting period applies notwithstanding the otherwise referenced reapplication rule, so this provision does not permit an earlier reapplication after a cause-based denial.
