California Codes, Business and Professions Code - BPC, Division 2 — Healing Arts, Chapter 9 — Pharmacy, Article 16 — Applications, Section 4202.6

Notwithstanding Section 480, the board may deny an application for licensure under this chapter if any of the following conditions apply:

(a) The applicant has been convicted of a crime or subjected to formal discipline that would be grounds for denial of a federal registration to distribute controlled substances.

(b) The applicant has been convicted of a crime involving fraud in violation of state or federal laws related to health care.

(c) The applicant has been convicted of a crime involving financial identify theft.

Notes

Allows the board to deny a pharmacy-chapter license application when the applicant has a crime conviction or formal discipline that would support denial of federal controlled-substance distribution registration, a conviction for state or federal health-care fraud, or a conviction involving financial identity theft. The denial authority applies notwithstanding the referenced general licensing provision.
