California Codes, Business and Professions Code - BPC, Division 3 — Professions and Vocations Generally, Chapter 4 — Attorneys, Article 5 — Disciplinary Authority of the Board of Governors, Section 6079.4

The exercise by an attorney of his or her privilege under the Fifth Amendment to the Constitution of the United Sates, or of any other constitutional or statutory privileges shall not be deemed a failure to cooperate within the meaning of subdivision (i) of Section 6068.

Notes

Establishes that an attorney’s exercise of the Fifth Amendment privilege or any other constitutional or statutory privilege does not constitute failure to cooperate for purposes of the attorney-duty provision referenced in the text. Invoking a protected privilege therefore cannot itself be treated as noncooperation under that duty.
