California CodesBusiness and Professions Code - BPCDivision 7 — General Business RegulationsPart 3 — Representations to the PublicChapter 4 — Fixed Term Installment ContractsSection 17860

Any waiver of the provisions of this chapter shall be deemed contrary to public policy and shall be void and unenforceable.

Notes

Bars enforcement of any waiver of the chapter’s provisions by declaring such a waiver contrary to public policy, void, and unenforceable. The rule prevents parties from contracting around the chapter’s protections and does not create a separate damages remedy, monetary penalty, notice period, filing deadline, or exception to the anti-waiver rule.
