Every person who, in response to an inquiry or request for any brand, type, or character of alcoholic beverages, sells or offers for sale under an on-sale license a different brand, type, or character without first informing the purchaser of the difference is guilty of a misdemeanor.
Notes
Prohibits an on-sale licensee from responding to a customer’s request for an alcoholic beverage of a particular brand, type, or character by selling or offering a different beverage without first informing the customer of the substitution. A violation of this disclosure requirement is a misdemeanor under the provision.
