Whenever, by the provisions of this code, a power is granted to a public officer or a duty imposed upon such an officer, the power may be exercised or duty performed by a deputy of the officer or by a person authorized pursuant to law by the officer, unless it is expressly otherwise provided.
Notes
Allows a public officer’s deputy or another person lawfully authorized by the officer to exercise powers granted to, or perform duties imposed on, that officer by the code unless the code expressly provides otherwise. The rule creates default delegability while preserving provisions that specifically require personal action by the named officer.
