California Codes, Civil Code - CIV, Division 2 — Property, Part 2 — Real or Immovable Property, Title 3 — Rights and Obligations of Owners, Chapter 1 — Rights of Owners, Article 2 — Boundaries, Section 829
The owner of land in fee has the right to the surface and to everything permanently situated beneath or above it.
Notes
Establishes that a fee owner of land owns the right to the land’s surface and to everything permanently situated below or above that surface. The ownership rule therefore extends the fee owner’s land interest vertically to permanent things beneath and above the property as well as to the surface itself.
