California Codes, Civil Code - CIV, Division 2 — Property, Part 4 — Acquisition of Property, Title 3 — Accession, Chapter 1 — Accession to Real Property, Section 1018

If a stream, navigable or not navigable, in forming itself a new arm, divides itself and surrounds land belonging to the owner of the shore, and thereby forms an island, the island belongs to such owner.

Notes

Establishes that when a navigable or nonnavigable stream forms a new arm, divides, and surrounds land belonging to a shore owner so that an island is created, the resulting island remains the property of that shore owner. The provision does not state a different rule based on navigability.
