California Codes, Civil Code - CIV, Division 2 — Property, Part 4 — Acquisition of Property, Title 4 — Transfer, Chapter 1 — Transfers in General, Article 1 — Definition of Transfer, Section 1040

A voluntary transfer is an executed contract, subject to all rules of law concerning contracts in general; except that a consideration is not necessary to its validity.

Notes

Defines a voluntary transfer as an executed contract governed by the general rules of contract law, while exempting that transfer from the usual need for consideration. The transfer therefore remains valid without consideration even though other generally applicable contract rules continue to govern it.
