California Codes, Civil Code - CIV, Division 2 — Property, Part 4 — Acquisition of Property, Title 4 — Transfer, Chapter 1 — Transfers in General, Article 3 — Mode of Transfer, Section 1052
A transfer may be made without writing, in every case in which a writing is not expressly required by statute.
Notes
Allows a transfer to be made without a writing whenever no statute expressly requires the transfer to be written. The rule makes an unwritten transfer permissible by default and limits the writing requirement to situations in which a statute specifically imposes one.
