A grant may be deposited by the grantor with a third person, to be delivered on performance of a condition, and, on delivery by the depositary, it will take effect. While in the possession of the third person, and subject to condition, it is called an escrow.

Notes

Allows a grantor to deposit a grant with a third person for delivery when a condition is performed. While the third person holds the instrument subject to that condition, the arrangement is called an escrow; when the depositary delivers the grant after performance, the grant takes effect.
