California Codes, Civil Code - CIV, Division 2 — Property, Part 4 — Acquisition of Property, Title 4 — Transfer, Chapter 1 — Transfers in General, Article 5 — Effect of Transfer, Section 1084

The transfer of a thing transfers also all its incidents, unless expressly excepted; but the transfer of an incident to a thing does not transfer the thing itself.

Notes

Establishes that transferring a thing also transfers all of its incidents unless they are expressly excluded, while transferring only an incident does not transfer the underlying thing. The provision distinguishes the effect of transferring the principal property from transferring an associated incident and provides an express-exception rule for the former.
