California Codes, Civil Code - CIV, Division 2 — Property, Part 4 — Acquisition of Property, Title 4 — Transfer, Chapter 2 — Transfer of Real Property, Article 2 — Effect of Transfer, Section 1110

Section Eleven Hundred and Ten. An instrument purporting to be a grant of real property, to take effect upon condition precedent, passes the estate upon the performance of the condition.

Notes

Sets a real-property grant that is expressly conditioned on a condition precedent to pass the estate when that condition is performed. The instrument’s stated condition delays passage until performance, and the provision does not identify a separate deadline, amount, recording requirement, or exception to that event-based transfer rule.
