The term “conveyance,” as used in Sections 1213 and 1214, embraces every instrument in writing by which any estate or interest in real property is created, aliened, mortgaged, or incumbered, or by which the title to any real property may be affected, except wills.
Notes
Defines “conveyance,” for the specified recording provisions, as every written instrument that creates, transfers, mortgages, encumbers, or otherwise affects an estate, interest, or title in real property. The definition excludes wills, while covering written instruments that can affect title even if they do not themselves transfer ownership.
