California Codes, Civil Code - CIV, Division 3 — Obligations, Part 1 — Obligations in General, Title 2 — Interpretation of Obligations, Chapter 2 — Joint or Several Obligations, Section 1432

Except as provided in Section 877 of the Code of Civil Procedure, a party to a joint, or joint and several obligation, who satisfies more than his share of the claim against all, may require a proportionate contribution from all the parties joined with him.

Notes

Allows a party to a joint or joint-and-several obligation who pays more than that party’s share of the total claim to require proportionate contribution from the other parties jointly liable. The right is subject to the exception provided in the specified Code of Civil Procedure provision.
