California Codes, Civil Code - CIV, Division 3 — Obligations, Part 1 — Obligations in General, Title 2 — Interpretation of Obligations, Chapter 4 — Alternative Obligations, Section 1451

If one of the alternative acts required by an obligation is such as the law will not enforce, or becomes unlawful, or impossible of performance, the obligation is to be interpreted as though the other stood alone.

Notes

Requires an obligation offering alternative acts to be interpreted as requiring only the remaining act when the other alternative is legally unenforceable, becomes unlawful, or becomes impossible to perform. The invalid, unlawful, or impossible alternative is disregarded rather than defeating the entire obligation.
