A covenant running with the land binds those only who acquire the whole estate of the covenantor in some part of the property.
Notes
Limits the binding effect of a covenant running with the land to persons who acquire the covenantor’s entire estate in some part of the affected property. Acquisition of less than the whole estate in any portion does not satisfy this statutory condition for being bound by the covenant.
