Novation is made by contract, and is subject to all the rules concerning contracts in general.

Notes

Requires a novation to be created by contract and subjects it to the general rules governing contracts. A substitution intended to operate as a novation must therefore satisfy ordinary contract requirements in addition to meeting the statutory rules describing the substitution of obligations or parties.
