California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 1 — Nature of a Contract, Chapter 2 — Parties, Section 1558

It is essential to the validity of a contract, not only that the parties should exist, but that it should be possible to identify them.

Notes

Requires not only that contracting parties exist, but also that they be capable of identification for the contract to be valid. A purported contract therefore fails this stated validity requirement when the parties cannot be identified, even if persons who might have contracted can be said to exist.
