California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 1 — Nature of a Contract, Chapter 3 — Consent, Section 1566

A consent which is not free is nevertheless not absolutely void, but may be rescinded by the parties, in the manner prescribed by the Chapter on Rescission.

Notes

Allows rescission of consent that was not freely given rather than treating that consent as automatically void. The affected parties may rescind the consent in the manner prescribed by the statutory chapter governing rescission, so lack of free consent makes the agreement voidable under that procedure.
