California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 1 — Nature of a Contract, Chapter 3 — Consent, Section 1580

Consent is not mutual, unless the parties all agree upon the same thing in the same sense. But in certain cases defined by the Chapter on Interpretation, they are to be deemed so to agree without regard to the fact.

Notes

Requires mutual consent to involve all parties agreeing to the same thing in the same sense. It preserves the special cases in the chapter on interpretation where the parties are deemed to agree despite the actual facts, so literal shared understanding is not required in those defined situations.
