California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 3 — Interpretation of Contracts, Section 1639

When a contract is reduced to writing, the intention of the parties is to be ascertained from the writing alone, if possible; subject, however, to the other provisions of this Title.

Notes

Requires the parties’ intention in a written contract to be determined from the writing alone when possible, subject to the other provisions of the same statutory title. The written instrument is therefore the primary source for ascertaining intent, but the title’s other interpretive rules still apply.
