California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 3 — Interpretation of Contracts, Section 1644

The words of a contract are to be understood in their ordinary and popular sense, rather than according to their strict legal meaning; unless used by the parties in a technical sense, or unless a special meaning is given to them by usage, in which case the latter must be followed.

Notes

Requires contractual words to be understood in their ordinary and popular sense rather than a strict legal sense, unless the parties used them technically or usage gives them a special meaning. In those exceptions, the technical or usage-based meaning governs interpretation instead of the ordinary meaning.
