California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 3 — Interpretation of Contracts, Section 1661

An executed contract is one, the object of which is fully performed. All others are executory.

Notes

Defines an executed contract as one whose object has been fully performed and defines all other contracts as executory. The distinction therefore turns on whether the contractual object is completely performed, not merely whether the parties have signed or otherwise formed the agreement.
