California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 4 — Unlawful Contracts, Section 1668

All contracts which have for their object, directly or indirectly, to exempt any one from responsibility for his own fraud, or willful injury to the person or property of another, or violation of law, whether willful or negligent, are against the policy of the law.

Notes

Establishes that contracts designed directly or indirectly to exempt a person from responsibility for that person’s own fraud, willful injury to another’s person or property, or violation of law, whether willful or negligent, are against public policy. Such exculpatory objectives are therefore disfavored by law.
