California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 5 — Extinction of Contracts, Chapter 2 — Rescission, Section 1688

A contract is extinguished by its rescission.

Notes

Establishes that rescission extinguishes a contract. Once a contract is effectively rescinded under the governing rules, the contractual relationship is terminated through that rescission rather than continuing to impose the obligations that would otherwise remain under the agreement, subject to the statutory rules that determine whether rescission was properly effected and what relief follows.
