California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 1.4 — Layaway Practices, Section 1749.2

Any waiver by the buyer of consumer goods of the provisions of this title, except as expressly provided in this title, shall be deemed contrary to public policy and shall be unenforceable and void.

Notes

Bars enforcement of a buyer’s waiver of the title’s provisions by declaring the waiver contrary to public policy, unenforceable, and void, except where the title expressly permits a waiver. The exception preserves only waivers affirmatively authorized by the title and invalidates other attempted waivers by buyers of consumer goods.
