California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 1.5 — Consumers Legal Remedies Act, Chapter 1 — General Provisions, Section 1751

Any waiver by a consumer of the provisions of this title is contrary to public policy and shall be unenforceable and void.

Notes

Bars a consumer from waiving provisions of the title by declaring any such waiver contrary to public policy, unenforceable, and void. The rule prevents an agreement from eliminating the title’s protections or requirements through a consumer waiver, because the provision gives that waiver no enforceable legal effect.
