California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 1.6 — Consumer Credit Reporting Agencies Act, Chapter 2 — Obligations of Consumer Credit Reporting Agencies, Section 1785.16.3

The provisions of subdivisions (k) and (l) of Section 1785.16 do not apply to a consumer reporting agency that acts only as a reseller of credit information by assembling and merging information contained in the database of another consumer reporting agency or agencies, and that does not maintain a permanent database of credit information from which new credit reports are produced.

Notes

Exempts a consumer reporting agency from the two referenced requirements when it acts only as a reseller that assembles and merges credit information from another consumer reporting agency or agencies and does not maintain a permanent credit-information database from which new credit reports are produced. Both reseller-only status and absence of a permanent report-producing database are required.
