California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 1.7 — Consumer Warranties, Chapter 1 — Consumer Warranty Protection, Article 2 — Definitions, Section 1791.3

As used in this chapter, a sale “as is” or “with all faults” means that the manufacturer, distributor, and retailer disclaim all implied warranties that would otherwise attach to the sale of consumer goods under the provisions of this chapter.

Notes

Defines a sale “as is” or “with all faults” as a consumer-goods sale in which the manufacturer, distributor, and retailer disclaim all implied warranties that would otherwise attach under the chapter. The defined sale therefore reflects a disclaimer by all three listed parties of the chapter’s otherwise applicable implied warranties.
