California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 1.86 — Consumer Contract Awareness Act of 1990, Section 1799.209

(a) If a consumer contract requires a dispute under the contract to be arbitrated and the dispute may be adjudicated pursuant to the Small Claims Act (Chapter 5.5 (commencing with Section 116.110) of Title 1 of Part 1 of the Code of Civil Procedure), the consumer shall be given the option to have the dispute adjudicated pursuant to that act.

(b) This section applies to a contract entered into, modified, or extended on or after January 1, 2025.

Notes

Allows a consumer whose contract requires arbitration to choose adjudication under the Small Claims Act when the dispute qualifies for that forum. Applies this option only to contracts entered into, modified, or extended on or after January 1, 2025, even though the contract otherwise requires the covered dispute to be arbitrated.
