California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 13 — Suretyship, Article 2 — Creation of Suretyship, Section 2793

Except as prescribed by the next section, a suretyship obligation must be in writing, and signed by the surety; but the writing need not express a consideration.

Notes

Requires a suretyship obligation to be written and signed by the surety, except as provided by the next statutory provision. The writing need not state a consideration, so the writing-and-signature requirement applies without an additional requirement that the instrument itself express the consideration supporting the obligation.
