California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 13 — Suretyship, Article 6 — Exoneration of Sureties, Section 2823

Mere delay on the part of a creditor to proceed against the principal, or to enforce any other remedy, does not exonerate a surety.

Notes

Sets that a creditor’s mere delay in proceeding against the principal or enforcing another remedy does not exonerate a surety. The surety therefore remains subject to the surety obligation despite that delay, whether the creditor postpones action against the principal or postpones enforcement of another available remedy.
