California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 13 — Suretyship, Article 7 — Position of Sureties, Section 2838

Notwithstanding the recovery of judgment by a creditor against a surety, the latter still occupies the relation of surety.

Notes

Establishes that a surety remains in the legal relation of surety even after the creditor obtains a judgment against the surety. Recovery of that judgment does not change the surety’s status, so the person continues to occupy the relation of surety despite the creditor having reduced the claim against the surety to judgment.
